DMCA Copyright Policy

This Policy explains how to report alleged copyright infringement involving PRIZ Guru, PRIZ Hub, and other PRIZ services, and how affected users may submit a counter-notification.

Copyright notices only. The process below is for claims under the U.S. Digital Millennium Copyright Act, 17 U.S.C. § 512. Questions about privacy, security, contracts, trademarks, or other matters should use the contacts identified in Section 9.

PRIZ Guru, Inc. (“PRIZ,” “we,” “us,” or “our”) respects copyright and expects users of PRIZ websites, the PRIZ Platform, workspaces, PRIZ Hub, and related services (collectively, the “Service”) to do the same. This DMCA Copyright Policy (the “Policy”) is incorporated into the PRIZ Guru Terms of Use.

1. Scope

This Policy applies when a copyright owner or authorized agent believes that material available through the Service infringes copyright. It does not determine ownership, fair use, licence scope, or the merits of a copyright dispute. PRIZ may request additional information, consider information reasonably available to it, and take action under the Terms of Use or applicable law.

Send DMCA notices and counter-notifications to PRIZ’s designated copyright agent:

Copyright Agent, PRIZ Guru, Inc.
111 NE 1st St, 8th Floor, 88699
Miami, FL 33132
USA
Telephone: +1 (561) 594-0256
Email: [email protected]

U.S. Copyright Office registration number: DMCA-1080019.

Email is the fastest submission method. Please use the subject line “DMCA Copyright Notice” or “DMCA Counter-Notification,” as applicable. Sending duplicate copies through multiple channels is unnecessary.

3. Notice of claimed infringement

To be effective under 17 U.S.C. § 512(c)(3), a written notice should include substantially all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
  2. Identification of the copyrighted work claimed to have been infringed or, if the notice covers multiple works at one online location, a representative list of those works.
  3. Identification of the material claimed to be infringing or the subject of infringing activity, together with information reasonably sufficient for PRIZ to locate it, such as the exact PRIZ Hub URL, project title, comment location, username, and relevant screenshot.
  4. Information reasonably sufficient for PRIZ to contact the complaining party, including a mailing address, telephone number, and, if available, email address.
  5. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, the owner’s agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right allegedly infringed.

If a notice lacks required information but identifies the copyrighted work, allegedly infringing material, and a way to contact the sender, PRIZ may contact the sender or take other reasonable steps to obtain the missing information.

4. PRIZ’s response

After receiving a substantially compliant notice, PRIZ may remove or disable access to the identified material expeditiously, notify the user who supplied it, request more information, or take other appropriate action. PRIZ may provide the notice and the complaining party’s contact information to the affected user. Removal or disabling under this process is not a determination that infringement occurred.

PRIZ may also remove or restrict material when it independently becomes aware of facts indicating infringement or when required by court order or other applicable law.

5. Counter-notification

If PRIZ removes or disables material because of a DMCA notice and the affected user believes the action resulted from mistake or misidentification, the user may send the designated agent a written counter-notification containing substantially all of the following:

  1. The user’s physical or electronic signature.
  2. Identification of the material removed or disabled and the location where it appeared before removal or disabling.
  3. A statement under penalty of perjury that the user has a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. The user’s name, mailing address, and telephone number.
  5. A statement that the user consents to the jurisdiction of the United States Federal District Court for the judicial district in which the user’s address is located or, if the address is outside the United States, for any judicial district in which PRIZ may be found, and that the user will accept service of process from the person who submitted the original notice or that person’s agent.

The counter-notification should identify the relevant PRIZ account and project or content location so PRIZ can match it to the original notice.

6. Possible restoration of material

After receiving a substantially compliant counter-notification, PRIZ will provide a copy to the person who submitted the original notice and inform that person that PRIZ may restore the material. PRIZ may restore the material or cease disabling access no sooner than 10 and no later than 14 business days after receiving the counter-notification unless the designated agent first receives notice that the complaining party has filed a court action seeking to restrain the user from engaging in the allegedly infringing activity.

PRIZ may decline to restore material for a reason independent of the DMCA notice, including a violation of the Terms of Use, another person’s rights, a legal requirement, a security or safety concern, or deletion or unpublishing by an authorized user.

7. Repeat-infringer policy

PRIZ’s policy is to terminate, in appropriate circumstances, users or account holders whom PRIZ determines are repeat infringers. PRIZ may consider the number, timing, nature, and apparent validity of infringement notices; counter-notifications and their outcomes; court orders; admissions; repeated uploads of the same or substantially similar material; and other relevant circumstances. PRIZ may act after a single event when the circumstances warrant.

PRIZ may document notices and enforcement actions and may restrict, suspend, or terminate accounts, remove content, or limit access as permitted by the Terms of Use and applicable law. PRIZ also accommodates and does not interfere with standard technical measures within the meaning of 17 U.S.C. § 512(i), to the extent applicable.

8. Misrepresentations

Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing or that material was removed or disabled by mistake or misidentification may be liable for damages, including costs and attorneys’ fees. Consider whether fair use, a licence, or another legal authorization applies before submitting a notice. PRIZ may disregard abusive, fraudulent, or bad-faith submissions and may take appropriate action under the Terms of Use or applicable law.

For trademark, impersonation, privacy, harassment, unlawful-content, or other reports that are not copyright claims, use the in-product reporting function where available or the PRIZ contact page. Send security incidents and vulnerability reports to [email protected]. Send other legal inquiries to [email protected].

This Policy does not limit any right or remedy available to PRIZ, a user, a copyright owner, or another person under applicable law.

10. Privacy and records

PRIZ may collect, use, retain, and disclose information contained in notices, counter-notifications, supporting evidence, and related communications to evaluate and administer claims, communicate with the parties, enforce the Terms, prevent abuse, comply with law, and establish or defend legal claims. PRIZ may share a notice or counter-notification, including the sender’s contact information, with the affected user, complaining party, advisers, service providers, authorities, or others as reasonably necessary for those purposes. Do not include unrelated confidential information or unnecessary Personal Information. The PRIZ Guru Privacy Policy provides additional information.

11. Changes and contact

PRIZ may update this Policy prospectively to reflect legal, operational, or Service changes. We will update the “Last updated” date and provide additional notice where required by law. Questions about this Policy may be sent to [email protected].
